The Madras High Court bench here has directed the Revenue Divisional Officer (RDO) of Tenkasi to consider the request of a Scheduled Tribe woman seeking a community certificate to be issued to her sons, and pass an order before July 29.
A division bench comprising Justices N. Paul Vasanthakumar and P. Devadass issued the direction while disposing the case of D.C. Mary Mercy Bai, a Scheduled Tribe woman. Mrs Bai had claimed in her petition that she belonged to the Christian Kaniyan community and that her husband M.R. Sureshkumar belonged to the Hindu Kaniyan community.
The petitioner’s counsel I. Robert Chandrakumar contended that the petitioner had submitted an application on February 7, 2012 to the RDO requesting a community certificate to be issued to her sons Muthuprakash Raj and Daniel Sugirtharaj. The RDO had directed the revenue inspector of Tenkasi to conduct an inquiry and submit a report, he added. The enquiry report was submitted to the RDO, but he failed to pass an order on the petitioner’s request, the counsel alleged.
The petitioner’s son Mr Muthuprakash Raj lost the opportunity of securing an engineering seat in the Anna University in the counselling held on June 25, 2013 because he did not have his community certificate, the counsel claimed. The petitioner’s second son was still in the school, he added.
He pleaded with the court to direct the officials to issue community certificates to both the petitioner’s sons.
